Coworking Adelboden Terms & Conditions

1. Use

1.1 Users
The use of the premises, workplaces and meeting rooms is generally open to all persons (guests, private individuals, businesspersons, associations, etc.) who comply with the terms and conditions set out here. For the purposes of this document, all those listed above are henceforth referred to as the “User”.

1.2 Personal Use
Co-Working Adelboden is for the exclusive use of the person or persons making the booking through the online platform. Sub-letting, re-letting or transferring the use of the workstations, rooms and meeting rooms to other third parties not covered by this contract is not permitted.

1.3 Code of Conduct

Access to the premises, workplaces and meeting rooms may be refused or withdrawn in the event of non-compliance with the code of conduct and the applicable house rules and non-compliance with general rules of acceptable behaviour.

Any activity likely to impair the smooth operation of the Co-Working Adelboden Wi-Fi hotspot, particularly any activity that places a disproportionately high load on the systems, is also prohibited. Adelboden Co-Working reserves the right to withdraw access to the facilities in the event of any action that is unethical, offensive or generally harmful to its business.

 

2. Infrastructure

2.1 Connections and Internet Access
Every room, workstation and meeting room has power sockets and connections that comply with current standards. Power adapters etc. must be provided by the User. Internet access is available through the Co-Working Adelboden Wi-Fi hotspot.

2.2 Data Security
TALK AG will take all appropriate organisational and technical measures to protect the confidentiality, integrity and availability of the connections and infrastructure for which it is responsible.

 

3. TALK AG Responsibilities and Limitation of Liability

3.1 Responsibility
TALK AG guarantees the services provided at Co-Working Adelboden.

3.2 Limitation of liability
All liability on the part of TALK AG is excluded to the extent permitted by law. Each User is responsible for their own personal insurance cover (liability insurance, accident and health insurance, etc.)

3.3 Data
Each User is responsible for the processing and protection of their own data. When using the digital infrastructure provided by Co-Working Adelboden, Users must be aware that any cached data or data sent or received via public networks may be accessible to third parties. TALK AG accepts no liability for any data loss or confidentiality breaches incurred by the User while accessing TALK AG’s digital infrastructure.

3.4 Force Majeure
TALK AG is not liable for interruptions and delays in the agreed services because of force majeure and other delays or obstacles for which it is not responsible. Force majeure includes (in particular but not exclusively) strikes, lockouts, traffic delays, extreme weather, internet and communication network failures, partial or complete destruction of the facility, and sovereign measures.

 

4. User Responsibilities and Liability

4.1 Liability and Unauthorised Use of Services Provided
The User is subject to the statutory provisions and restrictions when retrieving, storing, transmitting, disseminating and displaying data. Use of Co-Working Adelboden facilities for unlawful or unauthorised purposes is not permitted. The User undertakes not to use the service in such a way as to damage, destroy, overload or otherwise render unusable the infrastructure provided or to cause disruption to other users. In the event of culpable, unauthorised use leading to damage affecting Co-Working Adelboden or TALK AG, the User must pay compensation for this damage.

4.2 Liability for Premises, Workplaces and Furniture/Fittings
The following User responsibilities and liabilities apply:

  • The User is obliged to insure their property and liability risk towards third parties (personal liability insurance).
  • The use of the Co-Working Adelboden workstations, premises and meeting rooms as well as their furnishings (decorative fittings, utensils, furniture, etc.), is at the User’s own risk. Under no circumstances is TALK AG liable for the improper use or use contrary to instructions of Co-Working Adelboden workstations or rooms.
  • The User is liable for any damage to or excessive soiling of the premises, for movable and immovable Co-Working Adelboden infrastructure, and the theft of materials (IT, utensils, decorative fittings, etc.) or furniture.
  • TALK AG reserves the right to charge the User for repairs, replacements, disposal and additional cleaning costs.
  • If the workstations, rooms or meeting rooms cannot be used temporarily owing to the actions of a User or Users, those persons will be liable for the damage and lost revenue incurred by Co-Working Adelboden as well as the resulting damage.
  • Workstations are considered work equipment and are intended exclusively for work purposes. All equipment must be handled with the necessary care. Any damage must be reported immediately to TALK AG or the host (the on-site TALK AG representative).
  • Similarly, any IT problems must be reported immediately to TALK AG or the host.
  • Document printing should be kept to a minimum.

 

5. Data Protection

The User agrees that personal data received by TALK AG for the booking of services may be used to process and handle the corresponding request by Co-Working Adelboden. Further information can be found in our data privacy statement.

 

6. Personal Items

TALK AG is not liable for laptops, valuables, money, items of clothing, etc. not covered by this contract. A small number of personal lockers for Users are provided. TALK AG may charge the User to store or remove items or documents left behind if they are not collected by the User when requested. TALK AG is not obliged to retain any materials left behind by the User.

 

7. Applicable Law and Place of Jurisdiction

These Co-Working Adelboden Terms & Conditions, the Co-Working Adelboden contract and all other services are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Thun, Switzerland, subject to mandatory jurisdictions.
